2. Products

We sell woodchip, mulch, compost, soil and other garden and landscaping products.

Many of our products are natural, recycled or processed organic materials. Their colour, texture, moisture content, weight, density and particle size may vary between batches.

Product photographs are for illustration only. Reasonable natural variations do not mean that a product is faulty or not as described.

Weights, dimensions, volumes and estimated coverage figures are approximate. Products may settle or compact during storage and transport.

Customers are responsible for ordering the correct product and quantity for their requirements.

3. Prices and VAT

All prices displayed on our website are inclusive of VAT at the applicable rate.

Delivery charges are calculated separately and will be shown before payment.

If an obvious pricing error occurs, we may cancel the affected order and issue a full refund.

4. Payment

Payment must be made using one of the payment methods available on our website.

Payments are processed securely by a third-party payment provider. More Than Mulch Ltd does not store customers’ complete payment-card details.

Products remain our property until payment has been received in full.

5. Local Delivery Charges

Local delivery is free within 10 miles of our delivery base at:

For delivery addresses more than 10 miles from our delivery base, a delivery charge of 50p per mile each way will apply to the distance beyond the free 10-mile radius.

For example, where an address is 15 miles from our delivery base, the charge will apply to the additional five miles in each direction.

Delivery distances will be calculated using the mapping or distance-calculation system used by our website.

The applicable delivery charge will be shown before payment.

6. Pallet Delivery

We may arrange pallet delivery for locations outside our normal local delivery area or where pallet delivery is more appropriate for the order.

Pallet delivery charges depend on the delivery address, the size and weight of the order and the carrier’s charges.

Unless expressly agreed otherwise, pallet deliveries are made to the kerbside or the nearest safe and accessible unloading point.

Pallet delivery vehicles may be large and may use a tail lift and pallet truck. A firm, level and accessible surface is required.

Pallet trucks cannot normally operate safely on gravel, grass, soft ground, steep slopes or uneven surfaces.

The delivery driver may refuse to enter or unload at a location they consider unsafe or unsuitable.

7. Delivery Access

Customers must provide an accurate delivery address and notify us of any restrictions that may affect delivery.

These may include narrow roads or entrances, low bridges, branches or cables, vehicle weight restrictions, gates, security access, soft or uneven ground, gravel surfaces, steep slopes, restricted parking or limited turning space.

Our drivers and delivery partners have final discretion over whether a delivery can be completed safely.

Unless otherwise agreed, products will be left at the nearest safe and accessible location.

Where delivery cannot be completed because inaccurate information was provided or suitable access was unavailable, we may charge the reasonable cost of redelivery or returning the products to us.

8. Delivery Dates

Any delivery date or time given is an estimate unless we expressly confirm that it is guaranteed.

Deliveries may be delayed by traffic, weather, vehicle breakdowns, road closures, carrier delays or other circumstances outside our reasonable control.

We will contact the customer where reasonably possible if a significant delay occurs.

We are not responsible for contractor charges, equipment-hire charges or similar costs incurred because a customer relied on an estimated delivery date.

9. Unattended Deliveries

Customers may authorise us to leave an order unattended at the delivery address.

The customer must provide clear instructions and ensure that the requested location is safe and accessible.

Where we follow those instructions, the order will be treated as delivered when it is left at the agreed location.

Responsibility for the products passes to the customer at that point.

We are not responsible for theft, deterioration or weather damage occurring after a correctly completed unattended delivery, except where caused by our negligence.

10. Collection

Where collection is offered, customers must wait until we confirm that their order is ready.

Customers are responsible for bringing a suitable vehicle and ensuring that it can safely and legally carry the order.

We may refuse to load a vehicle where we reasonably believe that loading it would be unsafe or unlawful.

Responsibility for collected products passes to the customer when the products are handed over or loaded into their vehicle.

11. Cancelling an Order Before Delivery

Customers should contact us as soon as possible if they wish to cancel or change an order.

We will try to accommodate the request, but we cannot guarantee that an order can be changed or cancelled after it has been prepared, loaded or dispatched.

Where an order is cancelled before dispatch, we will refund the price paid together with any delivery charge that has not already been incurred.

12. Consumer Cancellation Rights

Customers buying wholly or mainly for personal use normally have the right to cancel an online order within 14 days after the day the products are received.

To cancel, the customer must clearly tell us by email or another written method.

After cancelling, the products must normally be returned to us within 14 days.

Unless the products are faulty, damaged, incorrect or not as described, the customer is responsible for the direct cost of returning them.

Because our products are heavy and bulky, returns may require a pallet carrier, haulage service or collection vehicle.

Where we agree to collect a cancelled order, we may deduct the reasonable direct cost of collection from the refund.

This cancellation right does not apply to business customers purchasing wholly or mainly for business purposes.

13. Condition of Returned Products

Customers must take reasonable care of products while they are in their possession.

Products should be kept dry, secure and free from contamination before return.

We may reduce a refund to reflect a loss in value caused by handling beyond what is reasonably necessary to inspect the product.

A reduction may apply where products have been used or spread, mixed with another material, removed from their packaging, contaminated, improperly stored, exposed to avoidable weather damage or otherwise handled in a way that prevents them from being resold.

This does not affect the customer’s rights where the product is faulty, damaged, incorrect or not as described.

14. Refunds

Approved refunds will normally be made using the original payment method.

For a valid consumer cancellation, we will refund the price of the returned products and any standard delivery charge that the law requires us to refund.

Additional delivery costs selected by the customer, such as an upgraded or more expensive delivery service, may not be refundable.

We may withhold the refund until the products have been returned or the customer provides satisfactory evidence that they have been sent back.

15. Faulty, Damaged or Incorrect Products

We are legally required to supply products that are of satisfactory quality, fit for their intended purpose and as described.

Customers should contact us promptly if a product is faulty, damaged, incorrect, significantly short in quantity or not as described.

We may ask for the order number, photographs and other reasonable information needed to investigate the issue.

We may also need to inspect or collect the product before providing an appropriate refund, replacement or other remedy.

Customers should not spread, mix, dispose of or continue using a product after discovering an obvious problem unless we have agreed otherwise.

Nothing in these Terms limits a customer’s statutory rights.

16. Natural Product Variations

Variations that may naturally occur in woodchip, mulch, compost and soil include differences in colour, texture, moisture content, chip or particle size, weight, density, organic content, odour and level of compaction.

Natural materials may also contain small amounts of leaves, bark, twigs or other naturally occurring organic matter.

Organic products may change colour, settle, decompose or develop harmless fungal growth over time.

These natural characteristics do not usually mean that a product is faulty.

17. Responsibility for Products

Responsibility for the products passes to the customer when the products are delivered, left in accordance with the customer’s instructions or collected by the customer.

After this point, the customer is responsible for storing and protecting the products.

18. Events Outside Our Control

We are not responsible for a delay or failure caused by circumstances outside our reasonable control.

These may include severe weather, flooding, fire, traffic disruption, road closures, vehicle breakdown, accidents, industrial action, supplier failure, carrier failure or government restrictions.

Where such an event occurs, we will take reasonable steps to reduce its effect and complete the order where possible.

19. Our Liability

We are responsible for foreseeable loss or damage caused by our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable when the order was placed.

We are not responsible for damage to driveways, paving, lawns, drains, underground services or other surfaces where the customer asks a delivery vehicle to leave the public highway, the surface is not suitable for the vehicle or load, a relevant hazard or weakness was not disclosed to us and the damage was not caused by our negligence.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of statutory consumer rights or any other liability that cannot legally be excluded.

20. Business Customers

This section applies where products are purchased wholly or mainly for trade, business, craft or professional purposes.

To the fullest extent permitted by law, we will not be responsible to a business customer for loss of profit, revenue, business, anticipated savings, contracts, goodwill or any indirect or consequential loss.

Subject to any liability that cannot legally be limited, our total liability to a business customer in connection with an order will not exceed the total amount paid for that order.

The courts of England and Wales will have jurisdiction, subject to any legal right a consumer has to bring proceedings elsewhere in the United Kingdom.
